Can You Employ a Nurse Directly?
Can You Employ a Nurse Directly?

Under current legislation and practice in Türkiye, the answer to this question has two dimensions: labour law and health law.

Short answer: Yes, registering the person for social security is technically possible; but there is no legal basis for it in terms of medical authority and responsibility for procedures.

1. Social Security (SGK)

A family member can insure the person who will provide care at home (a nurse, caregiver or companion) under the “domestic workers” scheme through a workplace file opened in their own name.

  • Simplified system: Under additional Article 9 of Law No. 5510, there is a simplified registration system for people working in a home for more than 10 days a month.
  • Scope: Registering the person this way makes them your official employee and secures rights such as work accident coverage and retirement.

2. Health Legislation and Medical Authority (The Critical Point)

The picture changes completely once nursing care comes into play. Under the relevant Ministry of Health regulations:

  • Institutional requirement: A medical procedure (injection, IV drip, wound dressing, etc.) may only be performed within a licensed health institution (a home care center) and under a physician’s prescription or supervision.
  • Risk of individual employment: Insuring a nurse personally and employing them at home technically puts that person in the status of a domestic worker.
  • Legal gap: In the event of a medical error at home, responsibility falls directly on the nurse and on you as the employer. Because the service was not obtained through a licensed institution, the procedure is regarded as unauthorised provision of health care.

3. The Main Risks in Practice

  • Shifts and continuity: If you employ a single nurse, care is interrupted by illness, leave or resignation. Institutions can provide replacement staff.
  • Lack of supervision: There is no responsible manager to oversee an individual nurse’s clinical standards (sterilisation, record keeping, medication follow-up).
  • Equipment: Managing medical devices and supplies falls entirely on the family.

Summary and Recommendation

Employing a nurse individually is legally possible in terms of insurance, but it carries serious risks for the safety of medical care.

Our recommendation: If only personal care and companionship (self-care, meals, dressing) are needed, individual registration is one option. But if professional nursing such as injections, medication management and clinical follow-up is needed, receiving care through a home care center licensed by the Ministry of Health protects both the patient and the family.
